Welcome to www.kikliindia.com ("KIKLI" or the "Platform"). KIKLI is an online multi-vendor retail platform or marketplace enabling independent fashion and lifestyle vendors ("Vendors") to list and sell their merchandise to customers ("Customers") across India and globally in international markets. KIKLI connects customers with independent designers, labels, and vendors who sell original fashion and lifestyle products.
By accessing, registering, or using the Platform, you agree to be bound by the following Terms and Conditions ("Terms"). By visiting the KIKLI website and/or by placing or selling products through the KIKLI website, you hereby unconditionally agree to abide by and be bound by these Terms.
KIKLI reserves the exclusive right to change, amend, or modify any part of these Terms and Conditions at any time at its sole discretion, without any requirement of prior notice, approval, or intimation to any party. Continued use of the Platform shall signify your deemed acceptance of the amended Terms.
1. DEFINITIONS
a. "KIKLI" refers to the online marketplace operated under www.kikliindia.com.
b. "Customer" or "User" refers to any individual browsing or purchasing products from the KIKLI Platform.
c. "Vendor" or "Seller" refers to independent labels or designers who sell products on the Platform.
d. "Product" means the items listed for sale by Vendors on the Platform.
e. "Service" means the Platform, logistics, support, and order processing offered by KIKLI.
f. "Order" means any confirmed purchase of Product(s) through the Platform.
g. "Platform Policies" refers to all additional policies listed on the site such as return, cancellation, refund, privacy, and shipping policies.
2. PLATFORM NATURE AND ROLE
KIKLI acts as a facilitator and intermediary under the Information Technology Act, 2000, providing an online marketplace where third-party Vendors independently list, market, and sell their merchandise. KIKLI neither manufactures nor stocks any of the Products and is not a party to the sale contract between the Vendor and the Customer.
KIKLI coordinates the collection of products from Vendors through its logistics partners and facilitates shipping to the Customers. However, delays caused by Vendors in providing products shall not be attributable to KIKLI. In such instances, KIKLI disclaims all liability arising from delayed deliveries, order cancellations, or Customer dissatisfaction.
KIKLI does not make any express or implied warranties regarding the merchantability, suitability, reliability, originality, or legality of the products sold by Vendors. KIKLI shall not be held responsible for any claims relating to defective, damaged, misrepresented, or infringing goods. Vendors remain solely liable for any loss, injury, or dispute that may arise in connection with their listed products.
3. REGISTRATION OF YOUR ACCOUNT
To make purchases or sell products through the Platform, you must first complete a one-time registration process which is free of charge.
You may register by:
- Creating a KIKLI account by submitting accurate, complete, and up-to-date information as may be required by the Platform;
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account. Unauthorized access due to your negligence or failure to secure your account details shall not be the responsibility of KIKLI. You agree to provide true and accurate information and update it as necessary. Misrepresentation or fraudulent use of your account will result in immediate suspension and possible legal action.
4. PLACING ORDERS
By placing an order on the KIKLI Platform, you agree to comply with the following terms governing the creation and acceptance of a legally binding contract:
Order Submission Process:
Products can be ordered by adding them to your shopping cart and completing the checkout process. Merely adding products to the cart does not constitute a reservation or guarantee of availability. The order will be deemed placed only upon successful submission and confirmation of payment.
Acknowledgment of Order:
Once you place an order, you will receive an automated email acknowledgment confirming that KIKLI has received your request. Please note that this acknowledgment is not an acceptance of your order, but only a confirmation that your request has been logged into our system.
Right to Refuse or Cancel Orders:
KIKLI reserves the absolute right to reject, cancel, or refuse any order at its sole discretion. This may occur in situations including but not limited to:
- Product unavailability or stock limitations
- Pricing or typographical errors on the Platform
- Failure to obtain authorization for payment
- Orders flagged as suspicious, fraudulent, or involving excessive quantities
- Technical errors or systemic malfunctions.
In the event your order is cancelled after payment has been processed, the amount will be refunded as per the applicable policy.
Acceptance of Order and Formation of Contract:
The order shall be considered accepted—and a binding contract formed—only upon issuance of an Order Confirmation Email from KIKLI. This email signifies that your order has been approved and is being prepared for dispatch.
Product Availability and Pricing:
All orders are subject to product availability at the time of processing. While we strive to ensure accurate pricing and inventory, errors may occasionally occur. In such cases, KIKLI reserves the right to cancel the order and issue a refund, or contact you for instructions prior to dispatch.
Order Limits and Restrictions:
KIKLI reserves the right to impose quantity restrictions on any product, cancel orders exceeding those limits, or restrict purchases deemed to be intended for resale or commercial distribution.
Shipping and Fulfillment:
Upon acceptance of the order, the product will be processed and shipped in accordance with our Shipping Policy. Delays due to Vendor-side logistics or external events are beyond KIKLI’s control and shall not be deemed a breach of this agreement.
Order Cancellation by Customer:
Once an order has been confirmed and processed, cancellation requests may be considered only as per the applicable cancellation policy (if any) and subject to KIKLI’s discretion.
5. VENDOR TERMS AND RESPONSIBILITIES
All Vendors on the KIKLI Platform acknowledge and accept the following obligations:
- Ensure that all products listed comply with applicable laws, including consumer protection, IP rights, labeling, and safety standards;
- Maintain accurate inventory data and ensure descriptions, images, size charts, prices, and specifications are correct and updated;
- Fulfill orders promptly and ensure that products are ready for pickup from the Vendor’s facility within the stipulated timelines, to enable timely delivery to the Customer by KIKLI’s designated logistics partner.
Vendor Responsibilities - Vendors are solely responsible for:
- Listing accurate and truthful product details
- Ensuring quality, originality, and lawfulness of products
- Accepting and fulfilling orders in a timely manner
- Informing KIKLI of stockouts or production delays
- Properly packaging orders using KIKLI-specified branding
Product Authenticity & Compliance Vendors warrant that:
- Products are original and do not infringe IP rights
- Handloom or handmade products carry relevant certifications, if applicable
- Materials used are ethically sourced and legal
- No prohibited, counterfeit, or unsafe items are listed
Returns, Delays & Penalties
- If a product is returned due to vendor fault (defect, wrong item), vendor bears forward and reverse shipping costs.
KIKLI shall not be liable for any failure by the Vendor to meet these obligations. Vendors will be held solely responsible for any product defects, misrepresentations, delays, customer complaints, or violations of applicable laws.
In the event of any claim or legal action arising out of a Vendor’s listing or conduct, the Vendor agrees to indemnify and hold harmless KIKLI, its directors, employees, and agents from any loss, damage, cost, or expense, including legal fees.
KIKLI reserves the right to suspend or delist any Vendor or product without prior notice in case of breach of these Terms, customer complaints, or legal violations.
6. CUSTOMER TERMS
Product Information All product details including size, color, fabric, and specifications are provided by the Vendors. While KIKLI strives for accuracy in presentation, it is not liable for discrepancies between product descriptions and delivered items.
Order Placement & Payment Orders are placed through the Platform and processed upon payment via available payment methods. KIKLI reserves the right to cancel or reject orders at its discretion, especially in cases of fraud, mispricing, or unavailability.
Shipping & Delivery KIKLI handles order dispatch and delivery coordination. Estimated delivery timelines are indicative and subject to delays from Vendors or third-party courier partners. KIKLI is not responsible for delays due to natural calamities, logistic disruptions, or vendor-side issues.
- Delivery will be made using the method selected during checkout. While estimated delivery timelines are provided at the time of order confirmation, these are indicative and not guaranteed, as delays may occur due to vendor readiness, logistics, or unforeseen circumstances.
- All deliveries require a signature at the delivery address. If no one is available to sign, customers must contact us promptly to arrange for alternative delivery or rescheduling.
- Responsibility for the goods transfers to the customer upon successful delivery.
- KIKLI reserves the right to deliver goods in installments based on availability or logistic considerations.
Limitation of Liability KIKLI is not liable for:
- Product defects, damages, or inaccuracies
- Delays in production or delivery
- Customer dissatisfaction with product aesthetics
Maximum liability shall not exceed the amount paid by the customer for the product.
7. DISCLAIMER OF WARRANTIES, INACCURACIES OR ERRORS
KIKLI endeavors to present accurate and updated content, including product information and images. However, the Platform may contain inaccuracies, typographical errors, or outdated information. KIKLI does not guarantee the completeness, reliability, or accuracy of such content.
Visual representations of products on the Platform are for reference only and may differ from the actual products received due to lighting, digital device settings, or vendor-provided imagery.
All services and content on the Platform are provided on an “as is” and “as available” basis, without warranties of any kind. KIKLI expressly disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
KIKLI is not responsible for the content of external websites linked on its Platform.
8. USER WARRANTIES AND RESTRICTIONS
By using the Platform, you warrant that:
- Your use is lawful and does not violate any applicable legislation;
- All information provided is truthful and not misleading;
- You will not engage in any activity that harms the Platform or interferes with its operations.
You agree not to:
- Upload or transmit any content that is defamatory, obscene, unlawful, or invasive of privacy;
- Post or transmit viruses, worms, or other malicious software;
- Use automated tools to scrape, harvest, or index the Platform without permission;
- Infringe upon the intellectual property or legal rights of KIKLI or any third party.
Any misuse of the Platform or breach of this clause may result in suspension or permanent termination of your access.
9. INDEMNIFICATION AND LIMITATION OF LIABILITY
Users and Vendors agree to indemnify and defend KIKLI and its affiliates from and against any third-party claims, losses, or liabilities arising out of:
- Their use or misuse of the Platform;
- Breach of these Terms;
- Violation of applicable law;
- Intellectual property infringement.
In no event shall KIKLI be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, whether in contract or tort, even if KIKLI was advised of the possibility of such damages.
KIKLI’s total liability in any matter shall not exceed the actual amount received by it in the transaction giving rise to the claim.
10. PAYMENT TERMS
KIKLI accepts the following payment methods: Visa, MasterCard, American Express, Visa Debit, Visa Delta, Electron, PayPal, and Cash on Delivery (COD). COD is available only for domestic orders up to ₹10,000. For orders ranging from ₹10,001 to ₹50,000, KIKLI may, at its discretion offer a partial payment option, where a portion of the payment is collected in advance and the balance is payable at the time of delivery.
All prepaid orders are charged at the time of placing the order. Prices are displayed in INR (or the local currency at checkout), and Customers are responsible for any additional fees charged by their bank or payment provider.
Shipping charges are shown separately at checkout and in the confirmation email. For international orders, Customers are solely responsible for any applicable taxes, customs duties, and import levies.
KIKLI reserves the right to cancel or revise any order in case of pricing or product listing errors. In such cases, Customers will be notified and refunded or offered revised terms.
KIKLI does not request any OTP (One-Time Password) for order confirmation, payment processing, or any other verification purpose. Customers are advised to never share their OTP, bank details, or other confidential information with anyone claiming to represent KIKLI. All official communications from KIKLI will be through our verified channels only. KIKLI shall not be liable for any loss or damage arising from unauthorized OTP sharing or fraudulent activity
11. SHIPPING POLICY
KIKLI facilitates the shipping of products from Vendors to Customers using its partnered logistics services. Shipping timelines are estimates and may vary depending on product availability, Vendor readiness, and logistical factors. KIKLI is not responsible for delays caused by the Vendor’s failure to hand over the product or unforeseen transit issues. All risk of loss and title for products pass to the Customer upon delivery.
The following shipping terms apply to all purchases made through the Platform:
Estimated Delivery Timelines:
Estimated delivery times are displayed on each product page under the product description. These estimates are indicative and may vary based on location, product type, and Vendor dispatch times.
Order Processing Time:
All orders undergo a standard processing period of up to 24 hours from the time of placement. During high-volume periods such as sales, promotions, or festivals, processing may take up to 72 hours.
Shipping and Delivery Responsibility:
While KIKLI coordinates shipping logistics, it shall not be held liable for delays resulting from a Vendor’s failure to hand over the product on time or for any unforeseeable transit delays. Risk of loss and title for items pass to the Customer upon delivery.
Address Accuracy:
Customers are responsible for providing accurate and complete shipping information. Orders cannot be rerouted or redirected once dispatched. KIKLI is not liable for orders undelivered due to incorrect or incomplete address details provided by the Customer.
Verification Protocols:
In order to minimize risk and prevent fraud, KIKLI may contact you to verify payment and order details. Delays caused by such verification shall not be attributed to KIKLI.
Domestic Shipping (India):
KIKLI offers Free Standard Shipping across India. However, a flat INR 250/- fee shall be charged for returns or exchanges on orders originally shipped with free delivery.
International Shipping:
International orders are subject to shipping charges based on weight, destination, and order value. Tracking details will be shared via email once the order is shipped.
Duties and Customs for International Orders:
Product prices shown for international orders are exclusive of import duties, customs taxes, and other governmental fees. These charges, if applicable, must be borne solely by the Customer upon delivery, in order to release the shipment from customs.
12. INTELLECTUAL PROPERTY
KIKLI is the exclusive owner of all intellectual property rights in the Platform, including but not limited to the KIKLI name, logo, trademarks, website design, code, graphics, and overall user interface. Unauthorized use, reproduction, modification, distribution, or exploitation of KIKLI's intellectual property without prior written consent is strictly prohibited.
However, KIKLI does not claim ownership over the intellectual property rights of the products listed by Vendors on the Platform. All intellectual property, design rights, trademarks, brand names, and copyrights in the products listed and sold by Vendors shall remain the sole property of the respective Vendors or their licensors. KIKLI shall not be held responsible for any infringement claims or disputes arising in relation to such third-party content.
13. PRODUCT AVAILABILITY AND PRICING
KIKLI does not guarantee the availability of any product listed on the Platform. Prices and availability of products are subject to change without prior notice at the discretion of the Vendor. KIKLI shall not be held liable for any modification, suspension, or discontinuation of any product or service.
14. TAXES AND COMPLIANCE
All Vendors are solely responsible for complying with applicable laws, including but not limited to GST filings, import/export regulations, and other state-specific taxes. KIKLI shall not be liable for any tax liabilities or regulatory violations incurred by Vendors.
15. DISPUTE RESOLUTION MECHANISM
In the event of any dispute, claim, or disagreement between a Customer and a Vendor arising out of a transaction conducted on the KIKLI Platform, KIKLI may offer customer support services to facilitate communication and assist in resolving the issue. However, such support is purely facilitative in nature and shall not be construed as KIKLI accepting any responsibility, liability, or any obligation. KIKLI’s role is limited to providing a neutral platform and customer support assistance; the resolution of disputes shall ultimately rest between the Customer and the Vendor. KIKLI shall not be held liable for any losses, damages, or claims arising from such disputes and shall be fully indemnified in all such instances.
16. TERMINATION OF ACCESS
KIKLI may, at its discretion, suspend or terminate your access to the Platform for violation of these Terms, misuse, or for any other reason deemed fit.
Upon termination, you must immediately discontinue use of the Platform. Any liabilities incurred prior to termination shall survive.
17. FORCE MAJEURE
KIKLI shall not be liable for any failure or delay in performance due to acts beyond its control including but not limited to acts of God, governmental actions, pandemics, strikes, network failures, or vendor-side delays.
18. GOVERNING LAW AND JURISDICTION
These Terms shall be governed and construed in accordance with the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts located at Delhi, India.
19. AMENDMENTS TO TERMS
KIKLI reserves the right to revise, modify, or update these Terms at any time without prior notice or consent. You are advised to review the Terms periodically. Continued use of the Platform constitutes your binding acceptance of such changes.
20. SEVERABILITY
If any provision of these Terms is held to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
